Goodbye to Jurisdictional Conflicts
One of the pillars of the new law is the resolution of the eternal conflict between the SEC (Securities and Exchange Commission) and the CFTC (Commodity Futures Trading Commission). For years, companies in the sector have found themselves caught in a crossfire of sanctions and conflicting interpretations.
Today the distinction is clear: the CFTC has exclusive jurisdiction over digital commodities (like Bitcoin and Ethereum), while the SEC will retain control only over tokens that present unequivocal characteristics of financial securities.
Decentralization and Self-Custody: The New Rights
The CLARITY Act introduces the concept of "project maturity". If a protocol proves to be sufficiently decentralized, its token is officially relieved of the typical obligations of corporate shares, freeing developers and DAOs from paralyzing bureaucratic burdens.
Furthermore, the law enshrines a fundamental principle for crypto ethics: the right to self-custody. The freedom of users to store their assets in private wallets (hardware or software) is legally protected, eliminating the risk of restrictions that would force the use of centralized intermediaries.
Security and Investor Protection
To prevent the recurrence of systemic disasters like the collapse of FTX, the new rules impose enormous standards on exchanges. Among the highlights:
Separation of funds: Absolute obligation to keep client capital distinct from corporate assets.
Total transparency: Regular audits and verified reserves to prevent the misuse of user liquidity.
America has chosen the path of clarity: fewer barriers to innovation, but strict rules on risk management. The challenge for the hegemony of digital finance is officially open.
